Document a New Hampshire claim dispute and understand the regulator’s role alongside legal advice.

Start With The Policy And The Specific Dispute
A New Hampshire auto claim may involve your own policy, another person’s liability coverage or several insurers. Identify the policy effective on the crash date and the particular loss being considered. Ask the adjuster to state the coverage under review, deductible if applicable and documents needed. Keep separate claim numbers for separate companies or coverage files.
Collect the declarations, endorsements, crash information, photographs, estimates and relevant receipts. Notify the insurer even if a police report has not yet arrived, and provide the agency and report number. Record the date of notice and save the confirmation. Avoid treating a report purchase or a conversation with the other driver as notice to an insurance company.
Build A Factual Chronology
Use a short timeline showing the collision, claim notice, inspection, estimate, document submissions and disputed decision. Attach each important letter or email to the event it supports. Distinguish facts you observed from information supplied by someone else. If something is uncertain, label it clearly and identify what document might resolve it.
Keep a communication log with names, dates and next steps. When a telephone instruction affects repairs, inspection or expense authorization, confirm it in writing. Retain portal uploads and receipts outside the portal. A later reviewer should be able to determine what was sent and when without reconstructing the history from scattered screenshots.
Understand Repair-shop Choice And Pricing As Separate Questions
RSA 417:4, paragraph XX protects an insured’s choice of automobile or glass repair business under the policy described there. The insurer may recommend a facility with the required choice disclosure. The provision also permits payment limits based on a fair and reasonable price, with a definition addressing a dispute between an independent shop and insurer.
This means the right to choose a shop should not be read as automatic approval of every charge. Ask the shop and adjuster to identify the exact labor, parts or repair operations in dispute. Obtain the competing estimates and a written explanation. Before authorizing disputed work, understand what the shop expects you to pay and what the insurer has approved.
If additional damage is discovered during disassembly, ask for photographs and a supplemental estimate. Confirm the insurer’s inspection or approval process before the work changes relevant evidence. Keep the initial estimate, supplement and final invoice together. Also ask about towing, storage and rental costs separately from the main repair total.
Make A Coverage Or Value Challenge Concrete
For a denial, request the policy provision and facts relied upon. For a vehicle-value dispute, check the vehicle description, mileage, options and pre-crash condition in the valuation. Identify each error and attach supporting evidence. For an unexplained delay, ask which information remains outstanding and who is responsible for the next step.
A proposed payment or release should be reviewed for the claims it resolves. Do not assume a form concerns only vehicle damage because it arrived with a repair offer. Save the document and seek individual advice when its scope is unclear. Keep negotiation correspondence separate from a calendar of policy and court requirements.
Contact New Hampshire Consumer Services
The Insurance Department’s organizational rules identify Consumer Services as the unit for insurance complaints and inquiries, including property and casualty disputes. They list 800-852-3416 and consumerservices@ins.nh.gov as contact routes, along with written and online complaint channels. Ask for the current submission instructions and a secure way to provide relevant sensitive documents.
Prepare the insurer’s legal name, claim number, policy if available, chronology and the specific conduct you want examined. Include relevant copies of the company’s response and your supporting records. A concise explanation helps the department distinguish a coverage question, handling complaint and disagreement that requires another forum. Retain the acknowledgment and reference number for follow-up, along with the exact attachments sent and any subsequent request for information.
Know The Department’s Authority And The Role Of Counsel
RSA 400-A:15-e authorizes complaint investigation and mediation efforts but expressly does not grant power to adjudicate claims. The statute also says representation by counsel, mediation or arbitration, and a civil action are not by themselves reasons to decline investigation. It permits deferral of certain mediation or enforcement efforts while related proceedings reach finality.
If you already have a lawyer, coordinate the complaint and supporting documents with that lawyer. Regulatory review is different from obtaining a binding court decision on the claim. Continue tracking legal and policy dates while the matter is under review, and save the department’s findings with your claim file. A complaint acknowledgment should not be treated as an agreement extending another deadline.
