Pennsylvania Car Accident Deadlines And Evidence Checklist

A published two-year limitation is only one part of a Pennsylvania timeline. Identify the claim and parties, then track reporting, insurance and evidence tasks separately.

Treat The Ordinary Limitation As A Starting Point

Pennsylvania Title 42, Section 5524 lists a two-year period for specified actions involving personal injury or death caused by another’s wrongful conduct and injury to personal property. The chapter also contains other periods and provisions affecting application. A reader should not turn that general rule into a personal last-filing-date calculation without reviewing the claim and facts.

Ask a qualified Pennsylvania lawyer what period applies to each potential claim, what event starts it and what notice, filing or service steps are required. Identify any government party, minor, deceased person or out-of-state connection. A deadline for one defendant or claim type should not be assumed to govern every issue arising from the collision.

Record Dates With Their Sources

Create a worksheet with the event date, the document containing the instruction, the required action and the person responsible. Keep a copy of the actual letter or policy provision beside the entry. If a date is only an estimate from a conversation, label it that way and ask for confirmation.

Separate legal deadlines from report availability and claim-processing updates. A records office’s expected delivery date tells you about the record, not whether a court action is timely. An adjuster’s promise to call next week does not answer when you must provide notice or file a claim. Put unresolved legal questions at the top of the worksheet rather than burying them behind routine administrative tasks.

Request The Report Without Treating It As The Whole File

PSP’s crash-report service says its reports are available 15 days after the collision. Its application also explains that the purchased reporting form excludes appended documents and photographs. Record what you have actually ordered and what additional material may still be needed.

If a local department investigated, identify that agency’s process separately. Keep the report number and request confirmation. Tell anyone reviewing a deadline which records are pending; do not wait for a complete investigation file before asking about a potentially time-sensitive claim. An incomplete file can still support a focused discussion when its limitations are made clear.

Preserve Records That Do Not Come With A Police Report

Collect your original photographs, video files, exchange information and witness contacts. Write down where each item came from and whether it reflects a direct observation. Save an untouched version before annotating an image or extracting a clip. Keep the surrounding context when preserving a message thread rather than retaining only one isolated sentence.

For nearby camera footage, identify the owner, location and likely time window. Ask promptly about preservation and the process for obtaining it. Do not assume a report request reaches a private business or preserves its recordings. If a formal preservation or access step may be necessary, obtain help appropriate to the evidence and the dispute.

Track Coverage And Insurer Requests Separately

The Pennsylvania Insurance Department’s coverage overview distinguishes medical benefits from liability and property coverage. Keep the policy, declarations and relevant endorsements with your claim correspondence so a reviewer can identify which request relates to which coverage. Note whether you are dealing with your insurer or another party’s insurer.

Enter each requested document, response date and delivery method in the worksheet. If the request is unclear, ask which provision or issue makes it relevant. Preserve the confirmation when information is sent. Do not assume that supplying one estimate or statement fulfills every policy obligation, and do not treat the insurer’s ongoing review as a substitute for a legal-deadline analysis.

Document Losses In A Way That Can Be Checked

Maintain separate lists for vehicle repairs, transportation, towing or storage, and other claimed losses. Each entry should point to an invoice, receipt, estimate or other supporting record. Label an amount as paid, billed or projected. If a bill is disputed, preserve both the bill and the written reason for disagreement.

Keep available employment records if time away from work is relevant. Store medical bills and records already obtained securely, with a note of requests still pending. This is evidence organization, not treatment advice. Before sharing sensitive material, verify the recipient and the purpose, and avoid sending unrelated records because they happened to be stored in the same folder.

Prepare An Actionable Review Appointment

Bring a short chronology, known party names, insurance information, court or agency papers and a list of missing evidence. Ask which legal issues need immediate action, which records can follow later and who will manage each task. If a lawyer has not agreed to represent you, do not infer that an inquiry or document upload means the lawyer is tracking your dates.

Update the worksheet after every substantive response. Keep the earlier version when a major fact changes so the history remains understandable. The goal is to identify unresolved obligations and evidence gaps early, not to create a calendar that looks complete while the controlling legal questions remain unanswered.
