Utah Car Accident Deadlines And Evidence Checklist

Use separate calendars for insurance tasks and legal review. Utah’s current statutory text is especially important when checking older deadline summaries.

Verify The Claim Type Before Using A Deadline

A crash may produce a vehicle-damage dispute, an injury claim, a policy issue and requests for government records. Those matters do not necessarily share a deadline. Write the claim or task beside every date you track. Record the source, the event that starts the period and the person who has verified its application. Leave an unresolved question visible rather than filling it with a date from an unrelated example.

For a legal review, prepare the crash date, place, parties, ownership information and a concise account of the harm involved. Identify any governmental vehicle, death, minor participant or unusual procedural history. Those details help a qualified reviewer decide which rules require attention; they do not establish an automatic extension or exception on their own.

Use The Current Utah Statute For Vehicle-property Questions

The legislature’s current text of Utah Code 78B-2-307(3), effective May 3, 2023, specifies four years for claims involving damage to a person’s motor vehicle or personal property from a motor-vehicle accident. This is a statutory reference point, not a calculation of your filing deadline. Application, accrual and special rules still need review for the particular facts.

Older summaries can be misleading here: the Insurance Department’s auto-claim page still contains a different property-damage period. This guide relies on the legislature’s current subsection for the limited proposition above. Ask qualified Utah counsel to determine the applicable period and required action, especially for an older accident or a matter involving a public entity. Do not resolve a source conflict by choosing whichever date is more convenient.

Give Insurance Notices Their Own Calendar

Collect the policy, declarations page, claim acknowledgment and all letters asking for information. Identify any stated notice, proof-of-loss or response requirement and ask the insurer to clarify ambiguous wording. Record when you received the request and when you supplied the response. A company saying that it is investigating does not, by itself, answer every timing question in the file.

Track multiple insurers separately. A property-damage discussion with one company may not address a benefit request under another policy. Keep the relevant claim number on each outgoing message and preserve proof of transmission. If a document is outstanding from a repair shop or other custodian, note that dependency and follow it up instead of marking the insurer’s request complete too early.

Preserve Records While Access Requests Proceed

UHP’s report-access instructions use an account-based portal and email notification when a report is available. Save the request reference, the scope of the request and the response. Keep your own photographs, exchange sheet and witness contact information while waiting. Do not assume that requesting the officer’s report also requests every recording or supplement.

For each potential evidence item, identify who created it and who may hold it now. A tow yard, repair facility, witness and government agency may possess different material. Record requests and responses with dates. If you need help preserving potentially important evidence, seek individual advice about the appropriate steps rather than assuming an informal inquiry prevents deletion or disposal.

Do Not Depend On A Presumed Traffic-camera Recording

UDOT’s records guidance says its intersection cameras provide live feeds and do not record or store footage. A camera visible at the scene therefore should not be your only evidence plan. Preserve your own files and identify other potential sources without claiming that they necessarily recorded the event or must release material to you.

Keep original digital files unchanged and use copies for cropping, labels or annotations. Record when you obtained each file and from whom. If a witness sends a recording, retain the accompanying message and ask for the original file where available. A still image extracted from a video can be useful for discussion, but it should not replace the underlying recording in your archive.

Document Losses In A Form Someone Else Can Check

Build an expense ledger with date, payee, purpose, amount and corresponding receipt. Distinguish paid bills from estimates, and note any reimbursement already received. Keep repair supplements and vehicle valuation materials in sequence. This allows a later reviewer to understand why the claimed amount changed without assuming that every version represents an additional expense.

Keep a dated personal chronology of events and communications. Separate direct observations from information reported by others. Add corrections as new dated notes instead of rewriting an earlier account to appear more precise than it was. Store sensitive records with access limited to the people who need them, and use verified channels when supplying them to an insurer or adviser.

Review the calendar whenever a new letter or record arrives. Update the next action, responsible person and proof of completion. Insurance correspondence, a records response and legal-deadline advice should remain separately identifiable, so progress on one does not obscure an unresolved task in another.
