Washington, D.C. Car Accident Deadlines And Evidence Checklist

Several D.C. timing rules can arise from one collision. Identify the insurer, potential defendant and required action before placing a date on the calendar.

Separate Three Kinds Of Legal Timing

An insurance-benefit election, notice of a claim against the District government and the filing of a civil action are different tasks. Create a calendar row for each potentially relevant issue and identify the source of its date. Do not label every row simply claim deadline. Record who will verify applicability and what evidence will show the required action was completed.

Gather the crash date and location, involved vehicles and parties, policy documents and any written notices already received. Identify whether a District agency, federal agency, transit organization or private business may be involved, without assuming they share one legal procedure. Those distinctions should be put before qualified counsel promptly rather than left until the insurance file is complete.

Address The PIP Election As A Distinct Decision

D.C. Code section 31-2405 requires a victim electing personal injury protection benefits to notify the PIP insurer within 60 days of the accident. The statute also addresses insurer notice, a mutual written extension and consequences for certain civil actions. Ask for prompt advice on coverage and the election’s effect. This checklist does not recommend making or declining that election in a particular case.

Preserve every election notice, form and communication. Record when you received it and whether any response was sent. If an extension is discussed, ask for the actual written agreement rather than relying on a recollection of a telephone assurance. Keep the election documents separate from routine claim forms so a reviewer can tell which action was actually taken.

Flag A Possible Claim Against The District Government

D.C. Code section 12-309 generally requires written notice within six months after injury or damage for certain unliquidated-damages claims against the District, subject to the statute’s qualifications. It specifies notice content and also addresses an MPD report made in the regular course of duty. Do not assume that any police report automatically satisfies the applicable notice requirement.

Bring the report and the full facts to qualified D.C. counsel for review of sufficiency, recipient, delivery and any additional procedure. A notice question should remain separate from a lawsuit-filing question. Preserve the actual notice, attachments, transmission evidence and acknowledgment if one is sent. Merely reporting the crash to an insurer does not document that this different task has been completed.

Review The Applicable Civil-action Period

D.C. Code section 12-301 includes three-year periods after accrual for property-damage actions and actions without a separately prescribed period, while identifying other categories and exceptions. That text is a starting point for individualized analysis. Ask counsel to identify the precise claim, accrual rule and any other controlling provision rather than applying a general number to every consequence of the crash.

Record the advice and next action in the calendar, including who is responsible. If a professional is reviewing the matter, clarify the scope of that work and whether any notice or filing has actually been undertaken. An initial conversation or document transfer should not be recorded as a completed legal action. Identify any death, minor participant, governmental party or cross-border issue for review. Those facts may raise additional questions; they do not establish an automatic extension. Do not wait for a settlement discussion to end before seeking an answer about the legal procedure.

Preserve Collision Records And Their Provenance

Keep original scene photographs, recordings, witness messages and the officer’s identifying information. Write a dated account of your own observations and label anything learned from others. Preserve messages accompanying a file so its source and receipt date remain clear. Use copies for annotations and retain the unedited originals in a secure location.

MPD’s PD-10 instructions explain report access using the CCN and appropriate request documents. Save the request and report separately from any legal notice. Ask about supplements or additional records if needed, and keep the custodian’s response. Obtaining a report copy does not itself establish that every potentially relevant item has been requested or preserved.

Keep Expenses And Insurer Communications Auditable

Maintain an expense ledger linked to receipts and invoices. Distinguish estimates, amounts paid, reimbursements and disputed balances. Save repair-estimate versions and vehicle valuation materials in order. Record the vehicle’s location and transfers if it moves between a tow yard, storage facility and repair shop, along with the associated contacts and documents.

For insurer requests, record the exact item, receipt date, response and confirmation. Keep policy notices and benefit-election documents distinct from ordinary estimate exchanges. If you use a DISB complaint, store its case number and responses in another section. Review the next-action list after each new document so reporting, insurance and legal tasks remain visible and separately accountable throughout the matter.
