Wyoming Crash Deadlines And Evidence Checklist

Keep legal deadline review separate from insurance follow-up and requests for crash records.

Sources Checked October 4, 2026 General Information

A Wyoming crash can create a records task, an insurance claim and a potential civil action at the same time. Each has its own purpose. Asking WYDOT for a report does not file a lawsuit, and an insurance claim number does not answer when legal action must begin. Start a chronology with the crash date, parties, reporting steps, documents requested and decisions received. Then identify which dates still need individual legal review.

Use The Ordinary Limitation Provision Carefully

The Wyoming Legislature’s Title 1 compilation includes §1-3-105(a)(iv), which sets four-year periods after accrual for listed actions including injury to personal property and certain injuries to rights not arising on contract. It is a starting point for ordinary negligence-related crash claims, not a universal last-day calculation. Section 1-3-102 expressly recognizes that a different statutory limitation can govern.

Have counsel identify the claim and applicable accrual rule before relying on a calendar entry. Tell the reviewer about a death, child claimant, possible government responsibility, out-of-state facts or uncertainty about the legal theory. Those details may require a different analysis. This guide does not assign an extension to any circumstance or suggest waiting until the end of an ordinary period while negotiations or an investigation continue.

Flag Government Involvement Immediately

The same official compilation contains the Wyoming Governmental Claims Act. Section 1-39-113 generally requires an itemized written claim to the governmental entity within two years of the alleged act, error or omission, subject to its stated provisions. Section 1-39-114 has a separate lawsuit period tied to filing that claim. The claim’s content, delivery and later court deadline need to be evaluated together.

A crash report, a call to a public agency and an insurance notice should not be assumed to satisfy that statutory claim procedure. If a public vehicle, employee or entity may be involved, provide the documents to counsel promptly and ask which requirements apply. Government liability and immunity also require analysis; identifying a notice provision does not establish that the government owes compensation for a particular road condition or collision.

Preserve Scene And Vehicle Evidence Early

Save original photographs, dashcam recordings and witness contacts. Note the time, location and source of each item. Keep a working copy for annotations so the original remains available. If a business, agency or other vehicle may hold relevant footage, identify the likely custodian and ask about preservation promptly. A lengthy ordinary limitations period does not mean every recording or physical item will remain available for that period.

Keep towing, storage and repair records with photographs taken before the vehicle changes condition. Record inspection requests and authorization communications. If the car may be sold, repaired or disposed of, discuss relevant evidence needs before the condition is no longer available to examine. Track actual costs with receipts and distinguish paid amounts from estimates. This makes it easier to evaluate the support for a particular expense later.

Obtain The Correct Transportation Record

The WYDOT crash report page directs individual report requests to Highway Safety using the case number if known, involved person’s name, crash date and requester contact information. Keep the request, payment and received file. The separate Driving Records service concerns a person’s driving history and uses its own identification and authorization process. Do not treat a history entry as a complete investigation report.

Ask the investigating agency about needed supplements or media that are not included. A report can help identify witnesses and describe recorded accounts, but preserve other evidence separately. Note factual discrepancies and request guidance about corrections without changing the original. Label an officer’s observations, a witness statement and your own later recollection accurately so a reviewer can understand what was actually known at each stage.

Keep Insurance And Legal Calendars Distinct

Preserve policy documents, claim notices, adjuster requests and written decisions. Record when each document was sent and acknowledged. Wyoming’s Department of Insurance offers a complaint route after an unresolved company dispute but says it cannot decide fault, determine a loss amount, force payment or interfere in litigation. A pending complaint therefore does not substitute for advice about a civil filing requirement.

Before accepting a proposed settlement, identify what claims and parties the release covers and what remains unresolved. Give counsel a short chronology with the underlying records, then ask which deadlines apply, what action satisfies them and who will take that action. Keep the confirmed answers with your calendar. The aim is a usable evidence file and a verified plan, rather than an assumption that one report, phone call or claim number protects every issue.
