West Virginia Car Insurance Claims: Identify Your Coverage

Name the specific coverage involved, keep the insurer’s explanation and use the correct complaint channel when a claim stalls.

Sources Checked October 4, 2026 General Information

The phrase “full coverage” is a poor starting point for a West Virginia crash claim. It does not identify which losses an insurer agreed to pay, which exclusions apply or whether another driver’s insurer accepts responsibility. Begin with the policy declarations, coverage forms and endorsements in effect on the crash date. Then describe the particular expense you want addressed: vehicle repairs, transportation, medical bills or another documented loss.

Replace “Full Coverage” With Named Coverages

The West Virginia insurance regulator’s Bulletin 21-02 explains that “full coverage” has no exact standard definition. Its discussion separates collision and comprehensive from options such as rental reimbursement, medical payments, underinsured motorist coverage and gap coverage. A conversation using only the general phrase can therefore leave you and the adjuster talking about different protections. Ask for the exact coverage name and relevant policy provision.

The bulletin also explains why a financed car can create confusion. Physical damage insurance does not necessarily eliminate the entire loan when the outstanding balance exceeds the vehicle’s value. Gap coverage is a separate issue. If your vehicle may be a total loss, request the insurer’s valuation and compare it with the lender’s payoff information. Do not assume the lender balance determines the vehicle’s insured value or that every policy includes gap protection.

Open A Claim With A Usable Record

When reporting the collision, retain the claim number, assigned adjuster, reporting date and contact details. Identify the vehicles, crash location and investigating agency accurately. Send requested documentation through the insurer’s designated channel and keep a copy of what was transmitted. If a document is not yet available, say so and record the request instead of guessing at its contents. Follow up on missing items in writing.

A State Police report can be requested using its crash report form. A local department’s record may require a different request. The form also treats photographs and recordings as separate categories. Tell the adjuster what you actually have: a report number, a report copy, photographs you took or media obtained from the agency. Those are different types of evidence and should not be described as if they are interchangeable.

Separate A Coverage Dispute From A Value Dispute

Ask the insurer to explain whether it is disputing coverage, responsibility for the collision, the amount of damage or the documents supporting a particular expense. For a coverage position, request the policy language and the facts the company relied upon. For a repair or valuation dispute, identify the estimate line, vehicle feature, condition adjustment or invoice that needs review. A focused written question makes the response easier to evaluate.

Keep transportation and storage records as well. Ask whether a particular coverage pays rental costs, what conditions apply and when the insurer believes payment ends. Obtain written information about towing or storage arrangements before assuming another party will pay indefinitely. The bulletin’s central point applies here: an optional benefit must be checked in the actual contract, rather than inferred from a general description of the insurance package.

Use West Virginia’s Property And Casualty Complaint Process

The Property and Casualty Consumer Services division accepts insurance complaints online or through its paper process. Its instructions ask for a detailed description, relevant policy information and copies of supporting correspondence. They also call for a signed and dated authorization so the office can investigate. A complaint package should explain who was involved, what happened, when the disputed decisions occurred and what response you are requesting.

Use copies and retain your originals. Include the claim number and company name, the adjuster’s written position, relevant policy excerpts and a short timeline. If you tried to resolve the issue with the company first, attach that request and response. Avoid burying the central issue in unrelated records. For example, a missing explanation for a denied rental expense is easier to investigate when the denial and applicable coverage appear together.

Understand What A Complaint Can Resolve

The division says it cannot decide negligence or fault, act as your lawyer, give legal advice or interfere with a pending lawsuit. Those limits matter when another driver’s insurer denies responsibility. The complaint route may help examine an insurer’s handling within the regulator’s authority, but it does not replace a court decision on contested facts or individual advice about whether to bring a claim.

Maintain separate calendar entries for requested documents, insurer responses and any legal deadline requiring review. Keep settlement or release paperwork with the claim file and understand which claim it addresses before signing. A complaint acknowledgment is not a promise of payment, and a pending records request does not answer whether a legal filing deadline is approaching. Escalate the specific unresolved issue with the documents needed to evaluate it.
